Terms of Service

By accessing and using Foundry Platform wellness centers, services, and digital platforms, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

These terms apply to all users of our services, including members, guests, service providers, and business partners. We reserve the right to update these terms at any time, and continued use of our services constitutes acceptance of any changes.

**Service Offerings**: Our wellness centers provide various services including but not limited to cold plunge therapy, sauna sessions, recovery circuits, massage therapy, and other wellness modalities.

**Health Requirements**: By using our services, you confirm that you are in good health and able to participate in wellness activities. You agree to disclose any medical conditions that might affect your ability to safely use our facilities.

**Age Requirements**: Services are available to individuals 18 years and older. Minors (13-17) may use services with parental consent and supervision as required.

**Assumption of Risk**: Wellness activities carry inherent risks. You assume all risks associated with using our facilities and services, and agree that participation is at your own risk.

**Membership Types**: We offer various membership plans with different terms, benefits, and pricing. Specific terms for your membership are outlined in your membership agreement.

**Payment Terms**: Membership fees are billed according to your selected plan (monthly, quarterly, or annually). Payments are due in advance and are non-refundable except as required by law.

**Cancellation Policy**: You may cancel your membership with 30 days written notice. Some membership types may have different cancellation terms as specified in your membership agreement.

**Late Payments**: Late payments may result in suspension of services and additional fees. We reserve the right to terminate memberships for non-payment.

**Respectful Behavior**: All users must treat staff, other members, and the facility with respect. Harassment, discrimination, or disruptive behavior will not be tolerated.

**Safety Guidelines**: Follow all posted safety guidelines and staff instructions. Report any unsafe conditions immediately.

**Personal Property**: Foundry Platform is not responsible for lost, stolen, or damaged personal property. Use lockers and secure storage for valuables.

**Cleanliness**: Maintain personal hygiene standards appropriate for shared wellness facilities. Shower before using certain facilities as required.

**Equipment Use**: Use all equipment and facilities as intended and according to posted instructions. Report any equipment issues to staff immediately.

**Reservations**: Some services require advance booking. We recommend booking early to ensure availability.

**Cancellation Notice**: Service appointments may be cancelled up to 24 hours in advance without penalty. Late cancellations or no-shows may result in fees.

**Rescheduling**: We will work with you to reschedule appointments when possible, subject to availability.

**Group Sessions**: Special terms may apply to group sessions or classes as communicated at the time of booking.

**Independent Contractors**: Many of our service providers (massage therapists, wellness coaches, etc.) are independent contractors, not employees of Foundry Platform.

**Provider Services**: Each provider is responsible for their own services, qualifications, and professional conduct. We facilitate connections but do not guarantee specific outcomes.

**Provider Agreements**: Service providers operate under separate agreements that outline their responsibilities, compensation, and standards of service.

**Dispute Resolution**: Any disputes with individual providers should first be addressed directly with the provider, with Foundry Platform available to facilitate resolution when appropriate.

**Platform Content**: All content on our platforms, including text, images, logos, and software, is owned by Foundry Platform or our licensors and is protected by intellectual property laws.

**User Content**: By sharing content (reviews, photos, etc.) on our platforms, you grant us a non-exclusive right to use, display, and share that content for business purposes.

**Trademark**: "Foundry Platform" and related marks are our trademarks. Unauthorized use is prohibited.

**Respect for IP**: Users must respect the intellectual property rights of others and may not use our platforms for any infringing activities.

**Service Provision**: We strive to provide excellent services but cannot guarantee specific results or outcomes from wellness activities.

**Platform Availability**: We aim for high platform availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects service.

**Third-Party Services**: We are not responsible for services provided by third-party providers, including independent contractors operating within our facilities.

**Damages**: To the fullest extent permitted by law, our liability is limited to the amount you paid for services in the 12 months preceding any claim.

**Health Disclaimer**: Our services are for wellness purposes and are not medical treatments. Always consult healthcare professionals for medical advice.

**Privacy Policy**: Our privacy practices are governed by our Privacy Policy, which is incorporated into these terms by reference.

**Data Security**: We implement reasonable security measures to protect your personal information, but cannot guarantee absolute security.

**Communication**: By using our services, you consent to receive communications related to your account, appointments, and services.

**Data Sharing**: We may share anonymized, aggregated data for business purposes while protecting individual privacy.

**Termination Rights**: Either party may terminate the service relationship as outlined in membership agreements or service contracts.

**Immediate Termination**: We reserve the right to immediately terminate access for violations of these terms, unsafe behavior, or illegal activities.

**Effect of Termination**: Upon termination, your right to use our services ends immediately. Some provisions of these terms survive termination.

**Data Retention**: We may retain certain information as required by law or legitimate business purposes after termination.

**Governing Law**: These terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

**Dispute Resolution**: We encourage resolving disputes through direct communication. If formal resolution is needed, disputes will be resolved through binding arbitration in Tucson, Arizona.

**Class Action Waiver**: You agree to resolve disputes individually and waive the right to participate in class action lawsuits.

**Severability**: If any provision of these terms is found invalid, the remaining provisions continue in effect.
